Health guarantee
The Seller hereby guarantees to the best of their knowledge said dog is to be in good health at time of sale and has received appropriate vaccinations and deworming for age.
The Buyer agrees to have the dog examined by a licensed veterinarian of your choice, at your expense within 72 hours of receipt of the dog. Proof of initial wellness examination must be provided to Seller after the initial vet visit. This guarantee will be terminated immediately if the dog is not examined within the allotted time. If the veterinarian determines the puppy to be in ill health with a life threatening illness or genetic defect proven by diagnostic testing the Buyer must notify the Seller immediately. Upon a signed written diagnosis from said licensed veterinarian, the puppy may be returned if this is agreeable to both parties. Buyer will have a replacement puppy of equal value from a future litter in a reasonable time frame ( up to 8 months ) or a full refund of the purchase price not including shipping and medical fees after the allotted 8 months. The Seller will not be responsible for any veterinarian/medical costs at any time which include but not limited to common conditions that are considered minor or correctable such as hernias, infections, parasites, coccidiosis, giardia, cherry eye, entropion, viral illnesses or improper bites. Seller does not accept responsibility for contagious diseases diagnosed after 3 days from date of receipt of the puppy. It also does not include any illness due to the ingestion of foreign objects or chemicals.
If this dog is found to have a hereditary defect which impacts clinically on its quality of life excluding dental work, by the age of 1 years as certified by a licensed veterinarian at Buyers expense, the Seller has the right to require a second opinion from a nominated veterinarian of Sellers choice at the Sellers expense. The Buyer must supply to the Seller a veterinarians report indicating possible hereditary defects within seven days of making the first complaint to the Seller. Should the dog be found to have Hip Dysplasia within the first two years, Buyer at their expense, must provide Seller with proof in the form of documentation from OFA or PennHIP. A copy of all available reports must be forwarded to the Seller for review by their nominated veterinarian. This guarantee does not include mistreatment of puppy, injury, accidents, poisoning or trauma that could lead to non-genetic hip dysplasia. The dog should not be allowed to become over or underweight and not used in agility or over exercised during their growth period for 12 months during the period of this guarantee. Upon the above requirements having been met, the Seller will replace with a puppy of equal value OR if the Buyer chooses to not to return the dog to the Seller, Seller will reimburse the Buyer for medical expenses up to and not exceeding the purchase price. It is understood that there may not be a replacement dog available at the time of requested replacement. The seller is given twelve months to act upon this guarantee. If the dog is euthanized or in any way disposed of, without a second opinion from the Sellers veterinarian, the Buyer waives all rights to a replacement puppy or to any financial payment as compensation. The breeder does not guarantee size or color of puppy when full grown. We will give the buyer the weight of the puppy’s parents.The puppy will be up to date on shots and worming at the time of pick up of the puppy. It is very important that you continue the vaccinations ( but Not over vaccinate the puppy, please read our section about vaccine) and worming. Please do not expose your puppy to other dogs that are not vaccinated or to any contagious or harmful diseases that may cause illness or death. Buyer is not to take puppy to pet stores, dog parks or any place where many dogs are present until the puppy has around 16-20 weeks old.
The Buyers Responsibility:
The Buyer agrees to feed a premium quality dog food, keep the dog at a healthy weight and have annual veterinary visits and keep all vaccinations current. The Buyer agrees to control the dog on a harness or leash when in public and when off the premises of the dog’s home. The dog’s outdoor area will be fenced in and secure, or acceptable provisions will be made to assure the dog is safe any time he/she is outdoors. The buyer must agree to housing the dog indoors as its primary housing. If the dog is found to be allowed to run freely, running at large, creating a public nuisance, or found to be neglected, abused or allowed to live in poor health or poor conditions the Seller has all rights to repossession of this dog with no refund to the Buyer. The death, injury or loss of said dog due to theft, carelessness, recklessness, abuse, neglect or accident will not entitle the Buyer to any compensation from the Seller.
In the event the Buyer is unable to keep this dog for any reason, the Buyer agrees to offer to the Seller the opportunity to help in rehoming the dog, or take it back without any compensation which must not be destroyed, or relinquished to a pound or shelter. Failure to comply with these provisions will render any guarantee null and void. The Buyers sole remedy is under the warranty provision of this contract and the Seller will not be liable for any other damages including consequential damages, property damage, emotional distress, loss of use, business interruption or veterinary fees unless specifically set forth in this warranty provision.
Please remember, a dog is a lifelong commitment.
The buyer agrees to never publicly post or share anything that may make the breeder look unethical or irresponsible on social media. If it is found that the buyer has caused someone else to have a negative opinion about the breeder and something is posted or shared by that person, the buyer understands that there will be legal action taken if the negative reviews cause the breeder to lose business in any way. The buyer understands that we are very open and honest about everything involving our puppies, we will talk to each person on our waiting list about their future puppy before they purchase the puppy from us, and we will always discuss any concerning condition or issue with our veterinarian. The buyer agrees to not spread rumors or negative opinions to other people that could cause those people to have a negative opinion on My Dream Doodle Puppy.
If the buyer does not comply with the above responsibilities listed under "The Buyer's Responsibility", there will be a $2,500 fee for breach of contract.
Note: Upon signature completion, this contract will become a legal and binding document, as agreed by Buyer and Seller. If the need should arise to settle any legal disputes concerning this puppy, buyer agrees to have all proceedings conducted in Hillsborough County, Florida and Buyer will be responsible for any legal/attorney fees if legal action needs to be taken in order to enforce the terms of this contract, and all legal proceedings will take place in the breeders parish.
